By downloading, installing, or using the Logistics Management System mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Logistics Management System is a comprehensive fleet management and logistics solution that provides:

Real-time vehicle tracking and monitoring
Driver management and assignment
Fuel purchase tracking and expense management
Geofencing and location-based alerts
Rescue and roadside assistance services
Ad-hoc cost tracking and management
Performance analytics and reporting
Driver communication and messaging

3. User Accounts and Registration

To use certain features of the App, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

4. User Conduct and Responsibilities

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to any part of the App
Interfere with or disrupt the App's operation
Transmit viruses, malware, or other harmful code
Collect or store personal data about other users without consent
Impersonate any person or entity
Use the App in a manner that could damage, disable, or impair the service

5. Location Services

Important: The App requires access to your device's location services to provide real-time tracking, geofencing, and location-based features. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy.

Location data is used for:

Real-time vehicle and driver tracking
Geofence alerts and boundary monitoring
Route optimization and navigation
Compliance with delivery schedules
Emergency assistance services

6. Intellectual Property Rights

The App, including all content, features, and functionality, is owned by Cynosure Ventures and is protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute the App
Reverse engineer or decompile the App
Remove any copyright or proprietary notices
Use the App for commercial purposes without authorization

7. User Content

You retain ownership of any content you submit to the App, including photos, messages, and other materials. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the App.

8. Payment and Billing

Certain features of the App may require payment. If you make any payments through the App:

You agree to provide accurate billing information
You authorize us to charge the designated payment method
All fees are non-refundable unless specified otherwise
You are responsible for any applicable taxes

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, we disclaim all warranties, including:

Merchantability and fitness for a particular purpose
Non-infringement of intellectual property rights
Accuracy, reliability, or completeness of the App

10. Limitation of Liability

In no event shall Cynosure Ventures be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cynosure Ventures and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or any violation of these Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the App or sending you an email. Your continued use of the App after such changes constitutes acceptance of the new Terms.
